The servers and databases that power PocketLink are located in India. We inevitably use a small number of third parties, some of which are outside of the India, to provide our service and we have contracts with each of them that oblige them to comply with the GDPR.

If you create an account on the Website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. User Content

You shall have sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all submitted Content. Billing and Payments

Where Services are offered on a free trial basis, payment may be required after the free trial period ends, and not when you enter your billing details (which may be required prior to the commencement of the free trial period). If auto-renewal is enabled for the Services you have subscribed for, you will be charged automatically in accordance with the term you selected. If, in our judgment, your purchase constitutes a high-risk transaction, we will require you to provide us with a copy of your valid government-issued photo identification, and possibly a copy of a recent bank statement for the credit or debit card used for the purchase. We reserve the right to change products and product pricing at any time. We also reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.
Your License to Us

created by you for us shall be deemed a “work made for hire”
when the work performed is within the scope of the
definition of a work made for hire in Section 101 of the
United States Copyright Law, as amended. As such, the
copyrights in those works shall belong to Pocketlink,
Pocketlink.io from their creation. Thus, Pocketlink,
Pocketlink.io shall be deemed the author and exclusive owner
thereof and shall have the right to exploit any or all of
the results and proceeds in any and all media, now known or
hereafter devised, throughout the universe, in perpetuity,
in all languages, as Pocketlink, Pocketlink.io determines.
In the event that any of the results and proceeds of your
submissions hereunder are not deemed a “work made for hire”
under Section 101 of the Copyright Act, as amended, you
hereby, without additional compensation, irrevocably assign,
convey and transfer to Pocketlink, Pocketlink.io all
proprietary rights, including without limitation, all
copyrights and trademarks throughout the universe, in
perpetuity in every medium, whether now known or hereafter
devised, to such material and any and all right, title and
interest in and to all such proprietary rights in every
medium, whether now known or hereafter devised, throughout
the universe, in perpetuity. Any posted material which are
reproductions of prior works by you shall be co-owned by us.
You acknowledge that Pocketlink, Pocketl.ink has the right
but not the obligation to use and display any postings or
contributions of any kind and that Pocketlink, Pocketlink.io
may elect to cease the use and display of any such materials
(or any portion thereof), at any time for any reason
whatsoever.
Limitations on Linking and Framing
You may establish a hypertext link to the Site so long as the link does not state or imply any sponsorship of your site by us or by the Site. You cannot frame, inline link, or use any of our content, material, or intellectual property on another website or service without our written permission.

To the maximum extent permitted by applicable law, the aggregate liability of Pocketlink, Pocketl.ink, Pocket link and its affiliates, officers, employees, agents, suppliers and licensors relating to the services will be limited to an amount greater of one dollar or any amounts actually paid in cash by you to Pocketlink, Pocketl.ink, Pocket link for the prior one-month period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.
Indemnification
To the fullest extent permitted by applicable law, in no event will Pocketlink, Pocketl.ink, Pocket link, its affiliates, directors, officers, employees, agents, suppliers or licensors be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if the liable party has been advised as to the possibility of such damages or could have foreseen such damages. Severability
This Agreement's rights and restrictions are only valid if they comply with applicable laws and don't render the Agreement void.If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid or unenforceable by a court of competent jurisdiction, it is the intention of the parties that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force and effect.
Dispute Resolution
The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of New York, United States without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of United States. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in New York, United States, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.
Assignment
You may not assign, resell, sub-license or otherwise transfer or delegate any of your rights or obligations hereunder, in whole or in part, without our prior written consent, which consent shall be at our own sole discretion and without obligation; any such assignment or transfer shall be null and void. We are free to assign any of its rights or obligations hereunder, in whole or in part, to any third party as part of the sale of all or substantially all of its assets or stock or as part of a merger.
Changes and Amendments
We reserve the right to modify this Agreement or its terms relating to the Website and Services at any time, effective upon posting of an updated version of this Agreement on the Website. When we do, we will revise the updated date at the bottom of this page. Continued use of the Website and Services after any such changes shall constitute your consent to such changes.
